Viral dances are a staple trend on TikTok, with the latest example being the ”ZombieBoy’’ dance. Kelley Heyer is the TikTok creator behind the viral ”Apple” dance. Specifically, the dance is choreographed to Charli XCX’s hit song ”Apple,” and it has become a popular trend on the platform. However, Heyer has filed a lawsuit against Roblox for using her choreography in an emote, a celebratory animation used by players in the game.

Moreover, Heyer has spoken about how it ”bums me out a little bit” when she saw big brands using her dance. Hence, the creator filed a copyright only a couple of months after she first posted the dance.
“That could have been a really good opportunity, really good exposure for me,” said Heyer.
TikTok Lawsuit
Heyer allegedly was talking to the company about licensing the choreography. However, they never ended up reaching a “signed agreement.”
”Kelley is an independent creator who should be compensated fairly for her work and we saw no other option than to file suit to prove that. We remain willing and open to settle and hope to come to a peaceful agreement,” said Heyer’s attorney Miki Anzai.
Roblox has stated that they have not done anything wrong and that they take intellectual property seriously as a business.
